LOUISVILLE, Ky. – A repo man has filed a wrongful arrest lawsuit against a Louisville Metro Police Department officer who is facing charges for lying during a grand jury presentation about the arrest.
Adam Hannahs claims Officer Leslee Wagner “made intentional and deliberate misstatements, omissions, and mischaracterizations” about his arrest on Sept. 5, 2013, according to the lawsuit filed in Jefferson Circuit Court Tuesday.
A mistrial was declared last week in Wagner’s criminal case after a jury could not come to an agreement.
Wagner and her husband Larry, who was also an LMPD officer at the time and is also named in the suit, arrested Hannahs at their apartment complex, where Hannahs was repossessing a vehicle.
After the vehicle’s alarm went off, the Wagners exited their home and approached Hannahs with weapons drawn, according to the suit.
The Wagners, who were were both off duty at the time, claimed Hannahs was uncooperative with them -- so they arrested him and charged him with assault, disorderly conduct and resisting arrest.
In the lawsuit, Hannahs claims he addressed the Wagners as “sir” and “ma’am” and was not aggressive.
Hannahs was later indicted as a result of Leslee Wagner's testimony to a grand jury, in which she claimed Hannahs cursed police, shoved one of the officers and attempted to flee.
But video Hannahs took during the incident showed the police were the aggressors.
"I'm going to shoot you in your fucking face you retard,” Leslee Wagner said, according to the video.
An internal LMPD investigation found Wagner's testimony to the grand jury did not match what the video shows.
Hannahs charges were dropped and Leslee Wagner was charged with perjury and false swearing.
Leslee Wagner still works for LMPD and remains on administrative reassignment.
A new pretrial date has been set for November with a jury trial beginning early next year.
The lawsuit is seeking unspecified monetary damages and a jury trial.
